Short-Term Rentals of Condominiums

With the increase of online platforms promoting and facilitating short-term accommodation rentals, such as Airbnb, VRBO, HomeAway and several others, there has been a surge of lawsuits, judgments, articles and myths surrounding the horrors experienced by some lessors (and their neighbours) in connection with short-term rentals. All of this should prompt condominium owners and their co-ownership syndicates to seriously consider the potential impacts of short-term rental of their units and the pertinence of preventive or control measures.

Spring Loading Recognized as an Offence Under the QSA in Québec

On August 9, 2016, the Tribunal administratif des marchés financiers (the “Tribunal”) formerly known as the Bureau de décision et de révision en valeurs mobilières (or BDRVM), rendered a two-part decision, the second part of which involved what is known as “spring loading”, now recognized as an offence under the Québec Securities Act.

Unjust Dismissal in Federally Regulated Organizations – the Rift in the Case Law Has Been Healed

The Supreme Court of Canada’s recent decision in Wilson v. Atomic Energy of Canada (“Wilson”) impacts more than 500,000 non-unionized employees, who work for organizations under federal jurisdiction (banks, telecommunications, interprovincial transportation enterprises and some Crown corporations). The decision puts an end to the controversy that had surrounded the remedy for unjust dismissal provided for in sections 240 to 246 of the Canada Labour Code2 (the “CLC”). It marks a major turning point for unjust dismissal hearings.
