For 25 years, Mylany David has been assisting clients and offering strategic and business advice in commercial and real estate law matters. Her expertise in developing and financing real estate, energy, infrastructure and agritech projects is especially sought-after. 

Clients call on Mylany’s help with complex issues that arise when acquiring land, seeking environmental permits, appearing before administrative tribunals, securing financing, and completing purchases and sales. By determining a project’s social acceptability and identifying and assessing risks, Mylany is able to negotiate win-win agreements and ensure stakeholder buy-in. 

Mylany has extensive expertise managing the legal aspects of projects that involve public-private partnerships or large procurement and construction components. In addition to negotiating agreements for the supply of equipment and electricity (PPA), and for securing the necessary property rights for the project (whether on private or public land), she ensures that the project complies with all bylaws and regulations and meets her clients’ goals. 

Mylany was named one of Canada’s Leading Infrastructure Lawyers by the Lexpert Special Edition on Canada’s Leading Infrastructure Lawyers in 2015, 2016, and 2018-2024. She is also consistently recognized as a leader in commercial and energy law. 

  • Counselled and assisted a major France-based renewable energy developer and operator in selling all of its assets and interests in Canada. 
  • Represented a leading organic cannabis producer in a sale of assets. 
  • Represented and advised the bank syndication of U.S. lenders who financed the CA$2.1 billion acquisition of an industrial portfolio of 187 properties in Québec. 
  • Negotiated strategic agreements in connection with public-private partnerships including for roads, bridges, rest areas, food concessions and health care centres. 
  • Counselled clients participating in requests for proposals, ensuring compliance of bids and advising on Québec public contract requirements. 
  • Negotiated leases and subleases of office space and industrial buildings. 
  • Advised on the development, permitting and financing of wind farms. 
  • Advised on the development, permitting and financing of privately owned hydroelectric projects. 
  • Represented clients in sales and changes in financial control, including with respect to property portfolios. 
  • Represented franchisors in connection with their real estate needs and relationships with franchisees. 
  • Negotiated and drafted development agreements for residential and commercial co-ownership properties and obtained necessary servitudes (easements). 
  • Appeared before administrative tribunals in connection with wind-energy infrastructure projects, including the BAPE and CPTAQ.
