Pierre-Olivier Lessard
PartnerPierre-Olivier Lessard focuses his practice on labour law and has a particular expertise in labour relations in unionized settings and in litigation involving the application of the Act respecting labour standards and the Labour Code. Though clients prize him for his litigation skills, Pierre-Olivier also frequently acts as spokesperson during collective bargaining and leads psychological harassment investigations.
He advises an extensive clientele consisting of employers in a wide range of areas, including public and parapublic services, manufacturing and energy. He is appreciated for his high standards, pragmatism and ability to correctly identify his clients’ issues, and thus to efficiently achieve their goals.
Defended employers in connection with grievances
- Represented employers in grievance arbitrations in matters involving dismissal, disciplinary and administrative measures, psychological harassment and outsourcing.
Represented employers before the Administrative Labour Tribunal
- Represented employers before the courts and advised on requests for certification by a union, decertification requests, complaints of interference, bad-faith negotiating, applications for an order to put an end to illegal strikes and in essential services matters.
Negotiation
- Spokesperson in connection with renewals of collective agreements in both the public and private sectors. Relevant experience in conciliation procedures before the Ministry of Labour and in preparing for and managing labour disputes.
Injunction
- Represented employers to prevent or contain pressure tactics in connection with labour disputes and to protect the interests of an employer dealing with unfair competition by a former employee.
Charter of rights
- Represented employers in lawsuits involving issues of privacy, discrimination, reasonable accommodation, electronic surveillance (GPS, cameras), investigations and surveillance, alcohol addiction, last chance agreements, etc.
Unfair competition
- Acted in connection with proceedings to obtain an order for the seizure of confidential documents, orders to enjoin the illegal solicitation of employees and clients, and damages. Relevant experience in drafting non-compete and non-solicitation clauses.
Psychological harassment investigation
- Acted as investigator in psychological harassment matters and drafted investigation reports for employers.
