The Firm Prevails Before the Administrative Justice Council

On September 25, 2015, the Conseil de la justice administrative (Administrative Justice Council) filed its investigation report in a case involving a complaint made by the Minister of Municipal Affairs and Land Occupancy against the President of the Régie du logement, Québec’s residential tenancy agency, an administrative tribunal. 

This landmark decision finally puts an end to this matter, which stems from a report from the Public Protector’s office dated September 2011. 

In its report, the investigative committee concurs with the argument put forward by Langlois Kronström Desjardins at the outset of the case whereby the initial request for the investigation was not based on any valid deontological grounds, such that the committee should have recognized that it did not have jurisdiction over this matter. 

Adopting the proposal made by Langlois Kronström Desjardins, the investigative committee also recommended to the Conseil de la justice administrative that a pre-investigation screening mechanism be put in place to avoid such redundant investigations in the future.
