Langlois Kronström Desjardins Wins Dismissal of Court Challenge of Decision of Québec National Assembly’s President
On September 21, 2010, Quebec Superior Court Justice François Huot dismissed a proceeding brought by Sun Media Corporation and the newspaper Journal du Québec challenging a decision of the President of Quebec’s National Assembly to refuse press-gallery accreditation of two of its journalists.
Langlois Kronström Desjardins represented the President of the National Assembly. Justice Huot accepted all of the arguments submitted by Langlois Kronström Desjardins in defence of its client in concluding that the Court was precluded from reviewing the President of the National Assembly’s decision not to accredit the two journalists, because of the President’s long-standing parliamentary privilege to exclude non-members from the precincts of the National Assembly. This is a precedent-setting decision on a fundamental constitutional law matter.
Previously in this same matter, Langlois Kronström Desjardins succeeded in securing the dismissal of a motion for a safeguard order.
Raynold Langlois, François LeBel and Jean-Philippe Abraham represented Mr. Yvon Vallières in his capacity as President of Quebec’s National Assembly.
