Léonie Derome and Jean-François Gagnon Publish an Article on the Confidentiality of an Insurer’s Internal Documents in InHouse Canadian Lawyer

The legal community in Canada can benefit from the expertise in insurance law of Léonie Derome and Jean-François Gagnon thanks to their article entitled “Confidentiality of internal documents” published in the reputed legal magazine InHouse Canadian Lawyer.

In the article they analyse a recent decision of the Quebec Superior Court holding that the internal file of an insurer is confidential by virtue of the litigation privilege, thereby departing from the reasoning of the Quebec Court of Appeal in the Solmax AIG decision. This decision shows that the courts’ analysis of the confidentiality of the internal documents of an insurer continues to be done on a case-by-case basis.
