
Mylany David

Mylany David practices commercial and real estate law, specializing in commercial, real estate and industrial transactions, and in the development and implementation of energy and infrastructure projects, particularly in the Agritech sector*.
Mylany represents real estate promoters, project developers, financial institutions, lessors and lessees, advising them on the myriad issues inherent in developing and completing projects, which can involve acquiring the necessary land, obtaining environmental permits, securing financing, negotiating purchase and sale agreements, appearing before administrative tribunals, etc. By identifying and assessing inherent risks, after having determined the social acceptability of a project, Mylany negotiates win-win agreements that have the buy-in of all stakeholders.
Whether the project involves public-private partnerships or large procurement and construction components, Mylany has acknowledged expertise in managing the legal aspects of projects. In addition to negotiating agreements for the supply of equipment and electricity (PPA), and for securing the necessary property rights for the project (whether on private or public land), she ensures that the project complies with all bylaws and regulations and meets her clients’ goals. Also known for her inspiring leadership, Mylany is instrumental transactions requiring the supervision of extensive due diligence teams. Finally, her understanding of this area earned her a nomination in 2017 as a director of the management committee of the Green Fund.
Mylany was named as one of Canada’s Leading Infrastructure Lawyers by the Lexpert Special Edition on Canada’s Leading Infrastructure Lawyers 2020, 2018, 2017, 2016 and 2015. She is consistently recommended as a leader in the commercial and energy (electricity) fields.

Since 2017, Langlois Lawyers has been representing a company in connection with the acquisition of a property located in Montreal West, province of Québec, for the cultivation of organic medical marijuana and the development of production facilities.

Condo Hotel: Proposed Acquisition of a Majority Interest in a Condo Hotel
Langlois Lawyers assisted a hotel operator with its due-diligence investigation and discussions in connection with the proposed acquisition of the majority of the units in a condo hotel. The transaction was not completed in light of the risks identified during the due diligence process.
Represented and advised the bank syndication of U.S. lenders who financed the CA$2.1 billion acquisition of an industrial portfolio of 187 properties in Québec
Negotiation of strategic agreements in connection with public-private partnerships including for roads, bridges, rest area/food concessions and health care centres
Counseling clients participating in requests for proposals, ensuring compliance of bids and advising on Quebec public contracts requirements
Negotiation of leases and subleases of office space, industrial buildings, and publicly owned land
Advising on the development, permitting and financing of wind farms
Advising on the development, permitting and financing of privately owned hydroelectric projects
Representing parties in the sale of and changes in financial control of property portfolios
Representing franchisors in connection with their real estate needs and relationships with franchisees
