On January 29, 2009, the Supreme Court of Canada refused leave to appeal a decision of the Court of Appeal of Québec rendered in favour of Langlois Kronström Desjardin’s clients, Glenn Mullan and Bruce Durham, two directors of Canadian Royalties Inc.
This puts an end to a $50 million dollar action in damages that Langlois Kronström Desjardins defeated on the grounds of res judicata (i.e., that the cause of action was previously decided by a tribunal of competent jurisdiction).
The judgment of the Court of Appeal, rendered by a unanimous bench, now stands as the leading authority in Québec on the principles of res judicata, particularly on the notion of the required identity of parties.
Langlois Kronström Desjardins was successful in this case before each instance with a team composed of Dimitri Maniatis, Raynold Langlois, Q.C., Marc-André Sansregret and Vincent de L’Étoile.
